Defendant Kay Olesen is charged with taking and shooting ducks by aid of baiting and over a baited area in violation of regulations issued by the Secretary of the Interior pursuant to the Migratory Bird Treaty Act, 16 U.S.C.A. § 703 et seq., the regulations providing in part that migratory birds may not be taken by "aid of baiting, or on or over any baited area." 50 C.F.R. § 10.3(b) (9).
