The issue is whether the Maine Turnpike Authority is immune from tort liability for personal injuries to a traveler arising from negligence in the maintenance of the Turnpike. The action was brought before the adoption of the new rules of civil procedure and is before us on exceptions by the plaintiff to the sustaining of defendant's demurrer in the Superior Court.
