This was an action to recover damages for personal injuries sustained by the plaintiff as the result of an automobile collision at an unmarked intersection of two county roads in Marion County, Kansas.

Plaintiff commenced the action by filing a petition, no part of which is abstracted. Defendant's motion to make this pleading more definite and certain was sustained.
