Plaintiff's action was originally brought at law, but by stipulation of the parties was tried in equity. It alleged the creation and maintenance of a nuisance by the defendant in the operation of its feed grinding, feed mixing and fertilizer sales business in the City of Vinton, asked injunctive relief and further prayed for damages. The trial court entered its judgment and decree awarding plaintiff damages in the sum of $3,605 for depreciation...
