PETERSON, Justice.

Appellant was charged in a County Attorney's information with operating a motor vehicle on a public highway while intoxicated, in violation of Section 321.281, 1958 Iowa Code, I.C.A. Upon trial the jury found him guilty. He was fined $300. He has appealed.
