In this action for damages for personal injuries, defendant appeals from the judgment entered on a jury verdict in favor of plaintiff.

The evidence appears to be substantially the same as that received in a prior trial of this case in which a jury also returned a verdict in favor of plaintiff. The judgment entered thereon was reversed upon appeal because of an erroneous instruction. (See Kumelauskas v. Cozzi,
