The first question presented by the writ of error is whether the trial court committed reversible error in overruling a motion to purge the plaintiff's petition of certain allegations which the defendant contends were prejudicial. Closely related to such assignment of error is special ground 4 of the defendant's motion for new trial which assigns error on an excerpt from the charge wherein the jury was instructed not to consider the allegations...
