This is an appeal from a judgment of conviction of murder in the second degree.

In an information filed in Los Angeles County the defendant was charged with willfully, feloniously and maliciously murdering Michele Bechtel on or about October 24, 1959. It was further charged that prior to the offense in question the defendant had been convicted of and served a term in prison for robbery and that he had been convicted of and served a term in prison...
