In a complaint filed in the district court for Douglas county defendant was charged with the crime of operating a truck loaded in excess of the weight limits provided in ORS 483.506.

Defendant appealed to the circuit court for Douglas county from a conviction in the district court. The circuit court sustained an oral demurrer to the reception of evidence and entered judgment for defendant on the ground that ORS 483.506 (3) violates...
