ROBERTS, Judge.

Defendant was found guilty by a jury on October 26, 1959, of manslaughter in the first degree. By a judgment entered November 4, 1959, he was sentenced by the court.

A preliminary hearing was held July 21, 1954. Defendant was represented by court appointed counsel. He was bound over for trial to the circuit court. An information filed by the state's attorney on November 2, 1954, contains two counts. In substance the first count charges that...
