Plaintiff, as the owner and the insured of the furniture, fixtures, equipment, and merchandise of the Sho-Bar, night club and cocktail lounge, seeks to recover of the defendant fire loss and damage allegedly sustained in a fire of January 13, 1958. Recovery is sought under an insurance policy of the defendant insuring said property against such loss and damage.
