Appellant Gerald Furman Stone and his co-indictee, James Richard Farrington, were jointly charged by indictment under Art. 1000, Vernon's Ann.P.C., with the offense of falsely reading, interpreting, and misrepresenting the contents of a written instrument affecting property.

Upon the granting of a severance, appellant was separately tried and convicted, and his punishment assessed at confinement in the penitentiary for 5 years.
