This is an appeal on questions of law from a judgment of the Court of Common Pleas of Montgomery County sustaining a motion to dismiss the notice of appeal and petition filed in that court in a case which arose under the Workmen's Compensation Act.

The record discloses that the Dayton Regional Board of Review disallowed the plaintiff's claim by an order dated June 26, 1958, which order concludes as follows:
