This proceeding for review of the referee's decision was served on defendant and filed in this Court. On motion of defendant the case was remanded for further action by the Secretary1 by order of the Court dated November 20, 1959.

On January 30, 1961, the Appeals Council rendered and filed its decision affirming the decision of the hearing examiner, and on June 3, 1961, defendant moved for judgment of affirmance...
