Respondent while proceeding at about 1:00 A.M. on December 26, 1955 in an easterly direction along Route 197 in rural Saratoga County, left the road at the point where Route 197 formerly crossed the Delaware and Hudson Railroad tracks in the Town of Moreau, struck the two guideposts closest to the bridge, careened through the guardrail on the southwest corner of the bridge and plummeted to the tracks 30 feet below. As a result of the accident claimant suffered grievous injuries...
