FORD, J.

An information was filed by which the appellant was accused of the crime of unlawful possession of heroin. (Health & Saf. Code, § 11500.) He was represented by a deputy public defender. Trial by jury was waived. He was found guilty. Both his motion for a new trial and his application for probation were denied. The judgment of the court was that he be punished by imprisonment in the state prison for the term prescribed by law.
