This is a motion, filed by the defendant on July 29, 1960, to dismiss the present action for failure of the complaint to state a claim upon which relief can be granted. Because this Court is of the opinion that it is without jurisdiction to entertain the present action, defendant's motion will be treated as one to dismiss the action for lack of jurisdiction over the subject matter.
