Defendants, husband and wife, owners of real property, appeal from an adverse judgment in favor of plaintiff, a licensed real estate broker who sued them for a commission. They make three contentions: (1) that the commission was to be payable only from sums to be received from the purchasers, which sums were never received; (2) that the exchange agreement procured by the broker was rescinded by the parties to it, and the broker's rights were thereby defeated...
