In the course of building a home on leased land near the intersection of Copper and First streets in the city of Hurley, plaintiff applied to the city for permission to make connection to the sewerage main in said intersection. With the city's knowledge plaintiff hired one Matt Johnson, who made the basement excavation for the home, to dig a trench from the sewer main to the home.
