BURKE, Judge.

This is a suit for damages for injuries received by the plaintiff in a collision between an automobile driven by him and an automobile driven by Reinhold Suko deceased. Trial of the action resulted in a verdict and judgment in favor of the plaintiff in the sum of $12,530.

Defendant made a motion for a new trial which was denied and he has appealed both from the order of denial and from judgment.
