DENNY, Justice.

At the close of the State's evidence each one of the defendants moved for judgment as of nonsuit. The motions were denied and each defendant rested without introducing any evidence, and renewed his motion. The motions were again denied and each defendant excepted to the ruling and assigns it as error. However, only assignments of error Nos. 42 and 43, set out in behalf of defendants Ashley and Dansavage, were brought forward and argued in the appellants...
