Four informations were filed in the municipal court of the city of Des Moines charging defendant violated certain penal provisions of its zoning ordinance. The municipal court, Howard W. Brooks, judge, sustained defendant's motion to dismiss the informations on the alleged ground of lack of authority in the city to enact the penal provisions of the ordinance.
