ROBERTS, Justice.

This is an action of trespass on the case for negligence brought to recover damages alleged to have resulted from a collision between two motor vehicles. On June 24, 1960 after the case had been called for trial in the superior court, the plaintiff was nonsuited by a justice of that court. The case is before us on the plaintiff's exception to that ruling of the superior court.
