In this action of tort the plaintiff seeks to recover for personal injuries sustained in a motor vehicle accident in this Commonwealth on August 20, 1954. The declaration contains two counts. In one, the plaintiff seeks to recover against Henry H. Fales, Junior, the alleged operator of the automobile; in the other, recovery is sought against Louise C.
