Donald S. Coby, the defendant-appellant, was tried and convicted by a jury of the crime of rape. This appeal is from the judgment entered on the verdict and the sentence of death imposed by the court.

Since the evidence has not been challenged it is unnecessary to relate the facts and circumstances surrounding the crime other than state that there was ample evidence tending to show that the appellant was one...
