The plaintiff, as duly appointed trustee in bankruptcy for Harold Gibleon, bankrupt, commenced this action against the defendant seeking to set aside and recover a payment in the amount of $11,704.97 allegedly made by the bankrupt to the defendant within four months of bankruptcy.
