The appellant, as plaintiff in the lower court, filed an action for damages for personal injuries received when a string of box cars was "kicked" against a box car in which plaintiff was working, by employees of defendant railroad. The plaintiff was unloading corn from the box car into his employer's truck when the accident occurred. The defendant denied negligence and the cause proceeded to a jury trial.
