Defendant, William Kiefaber, having been convicted by a jury of the charges of burglary and conspiracy has moved for a new trial. In order to appreciate the problems involved, it is necessary that we refer in some detail to the nature of the charges against defendant and the evidence produced before the jury to establish his guilt.
