The defendant was tried and convicted by a jury on three indictments, which respectively charged (1) an attempt to break a safe; (2) breaking a safe; and (3) breaking and entering a building of the Hillcrest Dairy, Inc., in the night time with intent to commit larceny and stealing $10,000.1 The verdicts were returned on June 16, 1960, and on the same day he was sentenced to imprisonment...
