This appeal arises out of an action instituted by the plaintiff against the defendant for malicious prosecution, resulting from the prosecution of the plaintiff by the defendant on a charge of grand larceny. The trial of the case resulted in judgment for the plaintiff for both actual and punitive damages, from which the defendant has appealed, alleging error in the rulings of the lower Court (1) in refusing defendant's motion...
