WHITTLE, Justice.

Bailey filed a motion for judgment against David Dudley Whitehead, III, and Paul Lambach for personal injuries resulting from a collision between two automobiles, one operated by Whitehead, and the other operated by Lambach in which Bailey was a passenger.
