Southern Railway Company, hereinafter called plaintiff, instituted an action against George Gilmer, Jr., M. E. Tremain, Betsy G. Tremain, and Decca G. Frackelton, in their own rights and as trustees, partners trading as Charlottesville Motor Co. hereinafter referred to as defendants.
