The plaintiff brought this action under the Federal Employers' Liability Act, 45 U.S.C.A. § 51 et seq., to recover for injuries alleged to have been suffered through the negligence of a fellow employee. The parties stipulated that the case should be tried to the court without a jury upon the testimony of the plaintiff. This is an appeal from a judgment in favor of the defendant railroad in which the court found that the plaintiff's injuries...
