At the close of the evidence offered by the plaintiff, the defendants under Rule 41(b) Federal Rules of Civil Procedure, 28 U.S.C.A., moved the court for a dismissal of plaintiff's claim on the ground that upon the facts and the law the plaintiff has shown no right to relief.
