Defendant was indicted by a grand jury for the crime of felonious assault with malice, and with a deadly weapon. He was found guilty by a jury of felonious assault. Section 559.190, RSMo 1959, V.A.M.S. The punishment imposed was one year in jail and a fine of One Thousand Dollars. The assault was upon one Harold Andrews.
