TIMBERS, District Judge.

Defendant Joseph A. Somohano, Jr., at the close of all the evidence, moved for a judgment of acquittal pursuant to Rule 29(b), Fed.R.Crim.P., 18 U.S.C. The Court reserved decision on the motion and submitted the case to the jury which convicted Somohano on counts one and three but acquitted him on count two. The Court grants Somohano's motion for a judgment of acquittal on count one and denies the motion as to count three.
