This is an action at law brought by Marvin C. Niemeyer, plaintiff, against Clarence W. Forburger, hereinafter referred to as defendant, and Cornhusker Heating and Air-Conditioning, also a defendant, to recover damages for injuries sustained by the plaintiff while working in a house being built by the defendant when a series of steps collapsed causing the plaintiff to fall and become injured.
