On June 10, 1960, the Grand Jury of Polk County returned an indictment against defendant, accusing him of operating a motor vehicle while intoxicated, as defined in Section 321.281, Code of Iowa 1958, I.C.A. Defendant pleaded not guilty. The case was tried to a jury. On December 8, 1960, defendant was found guilty as charged.
