The defendant was jointly indicted, with Harry Joseph Gossett and Bernard Clay, for the crime of breaking and entering the building of the Hiland Potato Chip Company, in Des Moines, in violation of Section 708.8 of the 1958 Code of Iowa, I.C.A. He was tried separately and found guilty by jury verdict, and from judgment on the verdict he appeals to this court.
