The defendant, after a trial in a Court of Special Sessions in the Village of Whitehall, before the Police Justice, without a jury, on February 21, 1961, was convicted of the traffic infraction of driving while his ability to operate was impaired, in violation of subdivision 1 of section 1192 of the Vehicle and Traffic Law.
