In this case the Plaintiff Essenburg sued the Defendant Cabane for damages to his motorcycle, and for personal injuries, alleged to have been caused to the Plaintiff by an accident in which an automobile driven by Defendant struck the rear end of the Plaintiff's motorcycle. The case was tried before a jury, but the Court found the evidence as to Defendant's negligence in causing the collision so clear and undisputed that the Court gave an instruction...
