This suit comes before us on appeal by defendant. Plaintiff, the insured of defendant, filed suit to recover benefits under a hospital expense policy, issued by defendant, together with an equal amount thereof and attorney's fees as penalties per LSA-R.S. 22:657. The trial court maintained an exception of no cause or right of action predicated on limitations in the policy sued on and dismissed plaintiff's suit. Plaintiff appealed the dismissal....
