SUMMERS, Justice.

On August 29, 1958, Frank Velotta was employed by the Washington-Youree Hotel of Shreveport, Louisiana, as a janitor. Prior to and on August 29, 1958, Liberty Mutual Insurance Company was the Louisiana Workmen's Compensation insurer of Velotta's employer.

This suit was instituted by Frank Velotta directly against the insurer,1 contending that he is totally and permanently disabled as the result of an accident...
