The defendant was convicted after a trial by jury of the crime of manslaughter in the first degree in 1953 and is presently serving a sentence of 20 to 40 years. An appeal from said conviction was dismissed in 1955 by the Appellate Division, Fourth Department (286 App. Div. 984).
