Oral argument has been waived in this case. We note at the outset, however, that counsel who represented appellee in the lower court has not seen fit to file a brief on behalf of his client. We feel that an attorney, in justice to the lower court, should attempt to sustain the lower court's ruling and aid the appellate court with a brief.
