Because of their identity of interest, the plaintiffs below and appellants here will be referred to as "Griffin" and the defendant below and appellee here will be named as the "Town."

Griffin sued the Town to recover amounts paid under protest by him on account of municipal gasoline taxes levied and assessed by the Town against Griffin; for an injunction restraining the Town from making further assessment...
