This is a suit for personal injuries brought by Homer R. Simmons against the Kansas City Southern Railway Company, under the Federal Employers' Liability Act, 45 U.S.C.A. § 51 et seq. Judgment was rendered for appellee Simmons in the amount of $139,615 based upon jury findings that appellant Railway Company was guilty of negligence and appellee was not contributorily negligent.
