On January 14, 1959 Roblek, doing business as Western Appliance and Furniture, filed suit against Horst, alleging that Horst on November 18, 1958 executed a promissory note for $3,731.94 in favor of Roblek, that Horst was in default, having paid nothing on this note, and accordingly sought judgment for $3,731.94 and interest and for attorney's fees in the amount of 15% of $3,731.94, as provided by the note.
