Convicted under the habitual criminal act of the felony of stealing a motor vehicle, appellant (Walter Emmett Daniels, hereinafter referred to as defendant) prosecutes this appeal from the judgment sentencing him to five years' imprisonment in the penitentiary, that punishment having been determined and imposed by the trial judge under § 556.280 and § 560.161 (these and all other statutory references are to RSMo 1959 and V.A.M.S....
