The offense is burglary with intent to commit theft with a prior conviction for burglary alleged for enhancement; the punishment, 12 years.

After the closing of the Western Auto Store about 5:30 P.M., Leo Porter and Bill Watson noticed something unusual about the side door of the store while passing by about 6:30-7:00 P.M. Upon investigation they saw two men kneeling beside the safe in the store. Porter and Watson remained at the store...
